On July 1, 2021, Virginia implemented the Virginia Overtime Wage Act (VOWA) that incorporates most of the Fair Labor Standards Act (FLSA) exemptions and requirements of employers to pay 1.5 times the regular rate of pay for nonexempt employees. However, VOWA adds different stipulations for determining an employee's regular rate of pay, overtime exemptions under VOWA, extended statute of limitations for overtime claims, and an expansion of available damages and remedies for overtime violations.
